Ticket for "Careless Driving"
I haven't had an auto accident since 2004, and that was someone else's fault. I haven't had a speeding ticket since 2006.

Yesterday, I got pulled over in Oregon and got a ticket for "careless driving." It was pretty scary. The cop claimed he had gotten calls about my driving, and I think he had been following me for a few miles.

He was desparate not to let me go, but couldn't find any reason to keep me. He finally let me go and told me to check into a hotel as soon as I could. I did this, even though I had an AirBNB reserved elsewhere.

I live in Texas, so showing up in court is not an option. I do have Legal Shield services and will be calling them on Tuesday.

The only thing my citation says is that I was going 70 in a 55 zone. I'm not sure how he could tell this from following me. He also said I was guilty of:

improper passing
going over the white line (on the side of the road)
changing lanes without signaling

I don't know why he didn't just pull me over immediately, instead of following me for how long. He finally pulled me on the approach to a bridge to the state of Washington.

I think he was seriously hoping for a DUI. I told him I don't drink at all.

He even searched the car. He found nothing.

Any ideas on how to fight or beat this? What is the best strategy to deal with this?

The fine is $265.

You hire a traffic ticket attorney in the jurisdiction that takes cases on contingency. You pay him a nominal fee no matter what, and if he can get the ticket knocked down or thrown out, you pay a higher fee. Prices range from $200-400, plus the actual court fee if any, depending on how big the jurisdiction is. Bigger cities have more attorneys competing, so generally the price is lower. There are two main benefits:

1. You don't have to show up to court in the middle of nowhere.
2. The attorney will usually at least be able to get it knocked down to a non moving violation, so it doesn't affect your insurance.

I'm as aggressive as possible with these. I got pulled over in almost the exact same scenario. Hadn't been drinking at all, but the cop was trying her hardest for a DUI charge. She "paced" me with her car to determine that I was speeding. This is garbage, and will usually get thrown out. Since the cop was tailing you, that's probably the method they were relying on here as well. In my case, the podunk town tried several times to settle with my attorney, but I rejected all offers. Eventually the whole thing got thrown out and I didn't have to show up to court or pay the town anything.

In general, you don't want to discuss anything with the cops on the side of the road. Arguing usually won't do any good, and will often just incriminate you. It's also best practice not to let cops ever search your car. Dirty cops will plant drugs during these searches. Just be polite, comply without giving them anything, and then fuck them in court later.

I disagree with this advice. If state law doesn't require you to perform field sobriety tests (as Texas doesn't from what I see), then you shouldn't do them. They're simply used as a tool to further incriminate you. Blowing on a breathalyzer will generally fulfill your legal obligation. Even then, I would request to use the one at the station house, so that it's harder for the cops to mess with.

Even if things came to a blood draw scenario, I would rather have my blood drawn and for it to show nothing than to "fail" some field sobriety tests that the cops allege must mean I was on something (weed, pills, etc.).

If they have enough reasonable suspicion on coban that you are possibly intoxicated you have to comply with HGN. 99% of the time the officer knows you're intoxicated. Again look up HGN its proven. Walk and turn and one leg stand I can understand but HGN is on the money. There's no breathalyzers where I'm at and if you say no to field sobriety test then you will be taken to the magistrate and be tested.

HGN can't test being high on pills, weed or k2 that's why they will blood draw.

I was driving a rental car with a Washington plate. I was on US Route 30, which basically follows the Columbia River from the ocean to Portland. The cop actually pulled me over as I was approaching a bridge.

I might agree with your sentiments if I had been driving a car with a plate from a small state on the east cost. I am sure it was not the only Washington plate driving on that road that evening.
