Convicted of sex crimes as a man, felon no longer deemed threat because of gender change

The Iowa Attorney General’s Office is no longer seeking the commitment of a former Midwest Christian Services student convicted of myriad sex crimes because the individual now identifies as a woman.

Court records show the state dismissed the application on Jan. 9. Attorney general spokesman Lynn Hicks wouldn’t comment on the reason for the dismissal other than to say “an offender’s hormone levels are an important part of substantiating an offender’s likelihood of recidivism.”

In November, the Storm Lake Times reported that Joseph Matthew Smith, a 23-year-old convicted of molesting a fellow MCS student in 2014, was “undergoing medical treatment that is needed prior to (Smith) potentially undergoing gender reassignment surgery.”

Smith has received treatment for gender reassignment over the past two years at Newton Correctional Facility. She first expressed a desire to “get started on transgender classification” in October 2017 and started using female pronouns.

Smith has expressed a preference to identify as Josie, according to court documents.

“We don’t believe we have evidence sufficient to prove Josie Smith has a significant chance of reoffending,” Hicks said late last week.


An Iowa Department of Corrections spokesman said Smith was transferred on Saturday to the Sioux City Residential Treatment Facility for transitional release. He did not say when Smith will be released.

Hicks cautioned the public not to overreact to Smith’s upcoming release. Smith will be subject to sex-offender registration requirements for the rest of her life, Hicks said, which includes regular meetings with a probation officer and a listing on an attorney general clearinghouse.

“Josie Smith will be subject to strict sex-offender reporting required of those who commit the crimes she did,” Hicks said. “She’ll be subject to supervision for the rest of her life.”

Hicks said the attorney general's office has never encountered a case exactly like Smith’s.

A preliminary report prepared by the state’s expert, Dr. Jeffrey Davis, says Smith molested as many as 15 victims, ranging from ages 1 to 13, before being sentenced to prison in December 2015.

The report found the likelihood of re-offending within five years of release exceeded 20% because victims were of both genders, and because Smith was under age 25 and never had a long-term relationship.

“Mr. Smith has not had an intimate relationship,” the report says. “His sexual encounters appear to have primarily involved molestation, including his own molestation by multiple perpetrators, or his victimization of others.”

The report says Smith was molested repeatedly as a child in Louisiana, starting at age 7.

The report recommended Smith be confined at the Cherokee Civil Commitment Unit for Sex Offenders (CCUSO) in Cherokee for an indefinite period. But it was premised upon Smith having the sex drive of a man.

Dr. Tracy Thomas, a forensic psychologist and former clinical director of CCUSO, said the statute that outlines civil commitment requires the state to “essentially prove an offender has a chance offending greater than 51% for the rest of his life.” That becomes harder to prove when an offender significantly lowers his testosterone levels, which has a significantly higher impact on sex drive than estrogen.

Thomas said there are no women confined at CCUSO.

“From an evaluator’s standpoint, our recommendation is based on whether someone is more than likely to re-offend,” Thomas said on Monday. “Between 5% and 15% of sex offenders re-offend, so it takes an extraordinarily high burden to prove someone has a 51% chance.”

Same argument used against priestly celibacy, incidentally; the idea that if you don't constantly coom you'll go crazy and rape a little boy. Funny how child abuse rates are identical in the Protestant churches, and 100x higher in the public school system...

Wait a minute. Testosterone doesn't just cause men to have higher sex drives. It's what makes men aggressive and violent as well.

This opens the door to men getting as pass on any violent crime by having their gender reassigned. "He won't kill again, your honor, because he's been pumped full of estrogen!"

Men as the active agents and stewards of society had its laws crafted around them so it does not surpirse me there is a gender quirk to the law which basically gives a big loophole to any felon. In this case the felon was likely molesting boys and will continue to do so as "Josie". This was like calculated by the felon as he realized a gender change would give him access back to his prey.

The same cohort of researchers that believe the wage gap is real and that single mother families are the ideal, are now going to use preponderance of chance to predict the recidivism of violent pedophiles? What could go wrong.

Commitment for those adjudicated as criminally insane used to be a polite way to save the mentally ill from a violent prison death, while holding them for the rest of their lives, now it sounds like a way to get paroled. Granted that your'e down to clown with tranny madness.

No, he's saying that men built a justice system to deal with men and that women were an afterthought since back in the day women were correctly presumed not to have agency and we're the burden of either their father or husband.

Women behaving badly were viewed in the same manner as a man's dog behaving badly. It was the fault of the man for failing to apply suitable discipline.

Even most "right wingers" these days are functionally so far Left on women's rights that they are irredeemable to logic. They somehow simultaneously hold the dual conflicting beliefs that women are lumped in with children on a societal level but must also be held to the same standard as men in terms of their behaviour.

In a true traditionalist society women would not appear in front of a judge for anything less than murder, and her husband would administer punishment for all lesser offences with a cane no wider than his thumb.

Now let me enjoy watching all the wilting flowers fall against their fainting lounges while their girlfriends look for the smelling salts. When you wake up you can figure out whether you want you want a viable social order with a proven track record or you simply want more women in jail to reconcile a juvenile need for "fairness" or more to the point because you want "society" to take women in hand without mentally having to reconcile that this is was our job as individuals in the first place, not the job of cops and judges while the other 99% of men in society continued on like soyfags.

No..

The system is built around and men and to punish men. Men are the stewards of society so law and order for much of history reflected this fact. Modern mutations to law have elevated women from dependents of men but have not granted them equal status and thus you have many laws that turn into weaker punishments for women if broken.
