She hit him with a stiletto heel to the ear/face from behind. He was bleeding. I think you can make a case that's deadly force:
"the apparently drunk straphanger, Shanique Campbell, poked fun at Pena’s jacket and his slight speech impediment before using her 6-inch stiletto as a weapon — hitting Pena behind the left ear and on his face."
No comment/opinion on the concealed carry aspect, but I'm thinking a competent attorney could convince me as a juror bleeding out your neck might be deadly.
You don't want to be in a position to have to fight for your life legally, trying to justify your deadly use of force, if you could have ran away instead. Each state is a bit different, Like Florida and their stand your ground statutes (e.g Trayvon Martin case). If you conceal carry you have to make sure your life is in danger (a pipe, a knife, a bat, another gun, etc). A regular fight is not enough to protect you from an overzealous prosecutor.
Problem is that we all know a fist fight can lead to death as well as high heel shoes and carkeys in a bitches hands can put eyes out, etc. Is that enough to pull out a pistol? In most cases no, but different lawyers have different views and it depends upon the state as well.
