New regulation defines sexual harassment, requires supportive measures for survivors, restores due process on campus

DeVos Finalizes New Title IX Regulations, Set to Take Effect in August

I haven't had time to read the regulations yet. The press release is written to sound good for everyone, while the liberal Universities are making "official statements" that are light on details and heavy on fearmongering. Maybe there's actual progress made in terms of reigning in the kangaroo courts ruining the lives of male students on frivolous claims.

Among the procedural protections guaranteed by the new regulations are:

  • An express presumption of innocence;
  • live hearings with cross-examination conducted by an advisor of choice, who may be an attorney;
  • sufficient time and information — including access to evidence — to prepare for interviews and a hearing;
  • impartial investigators and decision-makers;
  • a requirement that all relevant evidence receive an objective evaluation.
The regulations also affirm institutions’ ability to use the “clear and convincing” standard of evidence, which the government previously forced schools to abandon in 2011 for the lower “preponderance” standard in sexual misconduct cases.

Do I understand correctly that this is to prevent people from getting kicked out of school without a trial? I'm trying to think if there's any disciplinary measures a college can take aside from just kicking you out.

I think this is more for the guy(s) accused to be able to defend himself properly. Guilty or not everyone has the right to defend themselves in a court of law. Too many times the accused man isn't even allowed to ask questions or see the evidence against him.
